In its regular package of infringement decisions, the European Commission pursues legal action against Member States for failing to comply with their obligations under EU law. These decisions, covering various sectors and EU policy areas, aim to ensure the proper application of EU law for the benefit of citizens and businesses.
European Commission calls on SPAIN to meet its obligation to protect the Delta del Llobregat
The Commission is calling on Spain to take further measures to protect and manage its Natura 2000 network, thus respecting its obligations under the Habitats Directive (Council Directive 92/43/EEC). In particular, Spain must take the necessary steps to avoid any further deterioration of the Natura 2000 site ‘Delta del Llobregat’ as a consequence of the implementation of large infrastructure projects, such as the expansion of Barcelona International Airport and Seaport.
The European Green Deal and the European Biodiversity Strategy indicate that it is crucial for the EU to halt biodiversity loss by protecting and restoring nature.
Despite being one of the most densely populated regions on the Iberian Peninsula, the fragile lentic ecosystems of the Llobregat Delta hosts an outstanding biodiversity and plays a crucial role in the migratory routes of many European bird species, contributing thus to preserve the overall coherence of the Natura 2000 Network.
The deterioration and possibilities to mitigate and compensate for the environmental damage caused by large infrastructure projects have been discussed with the Spanish authorities since 2013. However, the commitments on mitigation and compensation taken by the authorities, e.g. the adoption and implementation of a Special Plan for the protection of the natural areas and landscape of Llobregat Delta and an extension of the Special Protected Area to protect the most suitable territories for the conservation of birds, have not been followed up sufficiently.
Therefore, the Commission is sending a letter of formal notice to Spain, which now has two months to address the shortcomings raised by the Commission. Otherwise, the Commission may decide to send a reasoned opinion.

La Comissió Europea demana a ESPAÑA que compleixi la seva obligació de protegir el Delta del Llobregat
En el seu paquet habitual de decisions sobre procediments d’infracció, la Comissió Europea emprèn accions jurídiques contra diversos Estats membres per no haver complert les obligacions que incumbeixen en virtut del Dret de la Unió Europea. Aquestes decisions, que abasten diferents sectors i àmbits d’actuació de la Unió Europea, pretenen garantir la correcta aplicació del Dret de la Unió en benefici dels ciutadans i de les empreses.
La Comissió demana a Espanya que prengui mesures addicionals per protegir i gestionar la seva Xarxa Natura 2000, respectant així les seves obligacions, en virtut de la Directiva sobre els hàbitats (Directiva 92/43 / CEE del Consell). En particular, Espanya ha d’adoptar les mesures necessàries per evitar qualsevol nou deteriorament de l’indret Natura 2000 «Delta del Llobregat» com a conseqüència de l’execució de grans projectes d’infraestructures, com les ampliacions de l’aeroport internacional i del port marítim de Barcelona.
Tant el Pacte Verd Europeo como la Estratègia de la Unión Europea sobre la biodiversitat indiquen que es fonamental que la UE posi fi a la pèrdua de biodiversitat i que la protegeixi i la restauri.
A pesar de ser una de les regions més densament poblades de la península ibèrica, els fràgils ecosistemes lenítics del Delta del Llobregat alberguen una biodiversitat excepcional i exerceixen un paper crucial a las rutes migratòries de moltes espècies de aus europees, contribuint així a preservar la coherència global de la Xarxa Natura 2000.
Des de 2013 s’ha dialogat amb les autoritats espanyoles sobre el deteriorament i les possibilitats d’atenuar i compensar els anys mediambientals causats pels grans projectes d’infraestructures. Tanmateix, no ha complert suficientment els compromisos assumits per les autoritats en matèria de atenuació i compensació, com ara, l’adopció i l’execució d’un pla especial per a la protecció de les zones naturals i el paisatge del Delta de Llobregat i de una ampliació de la zona de protecció especial a fi de salvaguardar els territoris més adients per a la conservació de les aus.
Per tant, la Comissió envia una carta d’emplaçament a Espanya, que disposa ara de dos mesos per abordar les deficiències plantades per la Comissió; de no fer-ho, la Comissió podria optar per enviar un dictamen motivat.
